1Statutory Legal Framework (DPDP Act & IT Rules)

This Privacy Policy is formulated in strict accordance with:

  • The Digital Personal Data Protection Act, 2023 (DPDP Act): Governing the lawful processing, consent architecture, purpose limitation, and storage limitation of digital personal data.
  • Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (IT SPDI Rules): Mandating comprehensive technical controls and designated grievance redressal for sensitive corporate data.
  • Consumer Protection (E-Commerce) Rules, 2020: Ensuring transparent disclosures of trade coordinates and nodal officers.

This policy governs data collected through the PINGAXIM B2B Wholesale Portal, mobile applications, distributor onboarding modules, and related communication channels operated by Pingax InMotion LLP.

2Categories of Commercial & Personal Data Collected

We collect and process only the minimal data strictly necessary for B2B trade execution:

Distributor KYC Data

Authorized proprietor/director names, trade firm designation, government identification (PAN, Aadhaar masked copies), and FSSAI registration.

Statutory Tax & GST Records

Active GSTIN registration certificate, registered business address, billing godown coordinates, and bank reconciliation statements.

Order & Logistics Records

Weighbridge slips, delivery challans, e-Way bills, GPS fleet transit logs, driver phone numbers, and destination unloading confirmations.

Technical & Cookie Logs

Session authentication cookies, language preferences, IP addresses, browser user-agent strings, and security event logs to prevent fraud.

3Lawful Purpose of Processing & Commercial Use

Data collected by Pingax InMotion LLP is utilized solely for lawful business operations:

  • Verification of commercial B2B buyer eligibility and credit evaluation.
  • Generation of statutory GST e-Invoices and government e-Way bills.
  • Coordination of dedicated freight trucks from Mahuva, Pollachi, and Tiptur depots.
  • Dispatch of transactional order alerts, weighbridge tickets, and payment receipts via SMS and WhatsApp.
  • Audit compliance mandated by tax authorities and agricultural commodity regulators.
We never sell, trade, or rent client or distributor commercial databases to marketing brokers.

4Data Storage, Security Protocols & Retention

Cryptographic Encryption & Hosting:

All digital records are stored within certified enterprise data centers located within the territory of India in accordance with national data residency norms. Data at rest is encrypted using AES-256; data in transit is protected via TLS 1.3 encryption.

Data Retention Period:

Commercial invoices, e-Way bills, and GST transaction records are retained for a statutory period of eight (8) financial years as mandated under Section 36 of the Central Goods and Services Tax Act, 2017. Inactive accounts may request data erasure subject to legal tax compliance.

5Rights of Data Principals under DPDP Act 2023

As a business client or distributor partner, you enjoy full statutory rights under Section 11 to 14 of the DPDP Act 2023:

  • Right to Correction & Erasure: Update outdated contact coordinates or request erasure of non-statutory records.

  • Right to Nominate: Nominate an authorized representative to exercise rights in case of death or incapacity.
